Welcome to Hits Bev Co, LLC (“Hits Bev Co,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our website, hitsbev.com (the “Site”), and your purchase or use of any products or services we offer (collectively, the “Services”). By visiting the Site or purchasing from us, you agree to these Terms and to our affiliated policies referenced here (Privacy, Shipping, Refund).

If you do not agree, please do not use the Site or the Services.

1. Eligibility & Use of the Site

You must be at least 21 years of age or older to purchase or consume any hemp-derived beverages offered through our Site.

By using the Site, you represent and warrant that:

  • You are of legal age in your jurisdiction for the products you purchase.

  • Any information you provide is accurate and complete.

  • You will comply with all applicable federal, state, and local laws governing the purchase, possession, and use of our products.

If you create an account, you are responsible for maintaining its confidentiality and for all activities occurring under your account credentials.

2. Product Information & Legal Compliance

Our beverages include:

  • Functional Drinks featuring ingredients such as Lion’s Mane, Cordyceps, L-Theanine, vitamins, minerals, adaptogens, and botanicals.

  • Hemp-Derived Drinks containing hemp extract compliant with the 2018 U.S. Farm Bill, with less than 0.3% Delta-9 THC by dry weight.

All product information and content provided on this Site is for general educational and lifestyle purposes only and is not intended as medical advice.

No Medical Claims:
 The statements made regarding our products have not been evaluated by the Food and Drug Administration (FDA). Our products are not intended to diagnose, treat, cure, or prevent any disease or medical condition.

Non-Psychoactive Notice:
 Our hemp-derived beverages are non-psychoactive and are derived from federally legal hemp. These beverages may not produce intoxicating effects and should not be confused with marijuana or products containing high levels of THC.

Restricted States:
 Due to state regulations, we do not ship hemp-derived products to the following states:
 California, Alaska, and Idaho.
 It is your responsibility to know and comply with your state’s laws before purchasing hemp-derived products.

Health Advisory:
 Consult your physician before consuming if you are pregnant, nursing, have a medical condition, or are taking medications. Do not mix with alcohol or drugs. Use responsibly.

3. Orders, Pricing & Availability

  • Offer & Acceptance: Submitting an order constitutes an offer to buy; we reserve the right to accept, limit, or refuse any order at our discretion.

  • Pricing: Prices are listed in U.S. dollars (USD) and may change without notice. Taxes and shipping are calculated at checkout based on destination.

  • Accuracy: We strive for accuracy in product descriptions, pricing, and images but errors may occur. We reserve the right to correct inaccuracies or cancel impacted orders.

4. Payment & Billing

By placing an order, you authorize us and our payment processor(s) to charge your selected payment method for the full order amount.

You agree to provide current, complete, and accurate billing and shipping information and to promptly update your account as needed.
 All transactions are processed in compliance with PCI-DSS standards and subject to fraud prevention screening.

5. Shipping, Delivery & Restricted States

Shipping timelines and methods are outlined in our Shipping Policy.

  • Functional beverages ship to all U.S. states.

  • Hemp-derived beverages are shipped only to states that permit hemp beverage sales under federal and state law.

  • We do not ship hemp-derived beverages to California, Alaska, or Idaho.

Orders containing restricted products to these states will be canceled and refunded.
 Title and risk of loss transfer to the customer once the order is handed to the carrier. We are not liable for carrier delays or delivery errors.

6. Returns, Replacements & Refunds

Because our beverages are perishable, we do not accept returns.
 Refunds or replacements are available only for verified damaged, defective, or missing items, as described in our Refund Policy.

7. Age Verification & Purchase Responsibility

By purchasing hemp-derived beverages, you affirm that:

  • You are 21 years of age or older.

  • You are purchasing for personal use only.

  • You will not resell or redistribute hemp products.

  • You understand that hemp-derived beverages must remain sealed and in their original packaging during transit and delivery.

We reserve the right to verify age and identity at checkout or delivery to ensure compliance with federal and state laws.

8. Promotions & Offers

All promotional codes, discounts, and limited-time offers are subject to change and may be revoked at any time.
They hold no cash value and are non-transferable.

9. Intellectual Property

All trademarks, designs, graphics, and content on this Site belong to Hits Bev Co, LLC. You may not copy, reproduce, distribute, or modify any materials without written authorization.

10. User Content & Reviews

By submitting photos, comments, testimonials, or feedback (“User Content”), you grant Hits Bev Co a perpetual, non-exclusive, royalty-free license to use that content in marketing or digital channels.
 You agree that your content will not contain:

  • False or misleading claims about product benefits.

  • Medical claims or references to disease, intoxication, or treatment.

  • Unlawful or defamatory material.

We may remove any content that violates these conditions.

11. Prohibited Uses

You may not use the Site or Services to:

  • Engage in unlawful, fraudulent, or misleading activity;

  • Post or imply any medical or therapeutic claims about hemp products;

  • Resell or distribute hemp beverages where prohibited;

  • Attempt to bypass geolocation or age restrictions;

  • Upload viruses, malware, or harmful code.

We may suspend or terminate access for any violation.

12. Disclaimers

THE SITE, SERVICES, AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
 TO THE FULLEST EXTENT PERMITTED BY LAW, HITS BEV CO DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not guarantee that the Site will be error-free, uninterrupted, or secure. We do not warrant that hemp-derived products are legal in every jurisdiction—it is the customer’s responsibility to understand and comply with applicable laws before purchase.

13. Limitation of Liability

To the fullest extent permitted by law, Hits Bev Co, LLC and its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, or consequential damages arising from:

  • Use or misuse of our products;

  • Delays or delivery issues beyond our control;

  • Customer’s failure to comply with local hemp laws.

Our total liability for any claim shall not exceed the amount you paid for the product in question during the 90 days preceding the claim.

14. Indemnification

You agree to indemnify, defend, and hold harmless Hits Bev Co, its affiliates, employees, and contractors from any claims, damages, or expenses (including legal fees) arising from:

  • Your violation of these Terms;

  • Your unlawful use or distribution of hemp products;

  • Your breach of local, state, or federal laws related to hemp.

15. Changes to Services & Terms

We may modify or discontinue any part of the Services at any time.
We may also update these Terms periodically; the “Last Updated” date above reflects the latest revision. Continued use of the Site constitutes acceptance of any modifications.

16. Governing Law

These Terms and any related disputes are governed by the laws of the State of Tennessee, without regard to conflicts of law principles.
All disputes shall be resolved in the state or federal courts of Davidson County, Tennessee.

17. Severability & Waiver

If any provision of these Terms is held invalid, the remaining provisions remain in effect.
 Failure to enforce any provision is not a waiver of our right to enforce it later.
